29 CFR 1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a) New residential construction located on Lot #6 at 697 Allier Terrace, Cumming, GA 30041. On or about 02/22/2023, and at times prior, the employer exposed employees to struck-by hazards while operating a pneumatic framing nail gun, in that protective eyewear was not provided while operating these tools at 120 PSI.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) Residential construction located on Lot #6 at 697 Allier Terrace, Cumming, GA 30041. Roof: On or about 02/22/2023, and at times prior, the employer exposed employees to fall hazards at approximately 19-feet, 4 inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities.
