On or about 01/29/2023, the employer did not ensure that a frequent and regular inspections were being conducted by a competent person designated by Kruse & Kamien Schaltanlagen GmbH at 1125 County Road 1A Ironton, OH 45638 to ensure that the job site, material and equipment; such as but not limited to the Fluke 77IV Multimeter was not adjusted to remove the fuse and allow employees to contact an energized 480V energy source located in the newly installed Electrical Cabinet (PK720/PK730) at PureCycle Ohio. The hazard last occurred on February 15, 2023.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about 01/29/2023, Kruse & Kamien Schaltanlagen GmbH (employer) working at site location 1125 County Road 1A Ironton, OH 45638, did not ensure that employees were instructed in the recognition and avoidance of unsafe conditions, specifically with arc flash and electrical hazards, while working on an energized 480V energy source located in the newly installed Kruse and Kamien Schaltanlagen GmbH Electrical Cabinets (PK720/PK730) at PureCycle Ohio with a modified Fluke 77IV Multimeter. The hazard last occurred on February 15, 2023.

29 CFR 1926.95(a):"Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) On or about 02/15/2022, the employer did not ensure that employees working on testing voltage, with a modified Fluke 77IV Multimeter, on an energized 480 volt power supply to a circuit breaker inside of a newly installed, Kruse and Kamien manufactured electrical cabinet used electrical protective equipment that would have been appropriate to protect employees from potential exposure to arc flash hazards.

29 CFR 1926.416(a)(1): No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work, unless the employee is protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means. a) On or about 01/29/2023, the employer did not ensure that employees whose duties were to test voltage, with a Fluke 77IV Multimeter, for an energized 480 volt power supply to a circuit breaker after installing a Kruse and Kamien manufactured electrical cabinet were protected against electric shock by guarding it effectively by insulation or other means. This last occurred on 02/15/2023.
