OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to burns.  a) On or about February 12, 2023, employees were exposed to a burn hazard when an employee cleaning the vent hood of the Hard Rock Caf� kitchen while standing on the SG14R Pitco fryers stepped into the approximately 350 degree Fahrenheit oil. While an employee was performing cleaning duties, they were standing on top of the fryers while they were still hot in order to reach the vent hood above them when their foot slipped into the hot oil in the fryer.

29 CFR  1910.28(b)(6)(i):(i) Each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard.  a) On or about February 12, 2023, the employer did not ensure employees standing above hot fryer oil while deep cleaning the fryer hood were protected from falling into dangerous equipment in that an employee's foot slipped into the hot oil while they were standing on the fryers, resulting in third degree burns.

29 CFR  1910.30(b)(1):(b) Equipment hazards. (1) The employer must train each employee on or before May 17, 2017 in the proper care, inspection, storage, and use of equipment covered by this subpart before an employee uses the equipment.  a) On or about February 23, 2023, the employer did not ensure employees performing jobs requiring the use of ladders were trained on their use before being allowed to utilize them.
