29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift. On or about February 22, 2023, employees were installing utility pipes in an excavation that was not inspected throughout the shift for evidence of a situation that could have resulted in possible cave-ins. If inspected by a competent person, they would have discovered that the excavation did not have cave-in protection in class "C" soil in an excavation deeper than five (5) feet or that a means of egress was not present in the excavation that was deeper than four (4) feet.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp, or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in-depth so as to require no more than 25 feet (7.62m) of lateral travel for employees. On or about February 22, 2023, employees installed utility pipes on the site's south side in an excavation four (4) feet or more in-depth without a safe means of egress. a. Trench A is the far east trench on site. It had three employees exposed. b. Trench B is the west side trench. It had two employees exposed. BOONE SERVICE, INC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(c)(2), which was contained in OSHA inspection number 1602578, citation number 1, item number 2, and was affirmed as a final order on March 6, 2023, with respect to a workplace located at 2514 Britany Ave, Baton Rouge , LA 70809.
