29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. a) On or about 1/10/2023 at 32267 Clubhouse Way at Baywood Greens, Long Neck, DE 19966: CSHO observed employees without safety glasses or personal protective equipment while conducting saw cutting operations. This exposed workers to eye, face or hearing injuries while using a gas operated chop saw during installation of landscaping pavers.

29 CFR 1926.1153(c)(2)(ii): Water was not applied at flow rates sufficient to minimize release of visible dust for tasks performed using wet methods: a) On or about 1/10/2023 at 32267 Clubhouse Way at Baywood Greens, Long Neck, DE 19966: CSHO observed employees operating a chop saw without using wet methods to minimize the release of visible concrete dust. The employees were conducting cutting of concrete pavers for installation.
