29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a) 6491 Thompson Road, Syracuse, NY 13202, 4th floor, on or about 2 /24/23: workers both were receiving and disposing of construction materials from a window opening on the 4th story (39 feet from ground) were exposed to falls where the sill of that window opening was 27 inches from the floor surface. The workers were not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.
