1910.95(d)(1)  When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  At a worksite located at 19151 E 39th St South, Independence, MO:   The employer failed to protect employees from occupational noise hazards. This was most recently demonstrated on or about June 22, 2023. This occurred when an employee in the tunnel/prep area was exposed to a dose of 66.5% or an equivalent of 87.0 decibels as an 8-hour time-weighted average and the employer had not developed and implemented a hearing conservation program. The sampling was performed for 479 minutes during one shift, exposure calculations included a zero time for the 1 minute not sampled.

29 CFR  1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used:  At a worksite located at 19151 E 39th St South, Independence, MO:   The employer failed to protect and train employees from both physical; as well as, health hazards associated with normal production at the facility including but not limited to the manual, and automated washing of motor vehicles. This was most recently demonstrated on or about February 18, 2023, and at times prior to when an employee in the tunnel/prep area was exposed to caustic chemicals and the employer had not trained employees on measures to protect themselves.  The training was not effective and did not include, but was not limited to the appropriate work, emergency procedures, and use of personal protective equipment associated with the application of the chemical "One Step Low Foam" also known as Bug Goo. This resulted in an employee being exposed to the resulting in burns to their knees and legs requiring hospitalization.

29 CFR  1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment:  At a worksite located at 19151 E 39th St South, Independence, MO:   The employer failed to protect employees from both physical hazards; as well as, health hazards associated with normal production at the facility including but not limited to the manual, and automated washing of motor vehicles through a written hazard assessment:   a) This was most recently demonstrated on or about February 18, 2023, and at times prior to when an employee in the tunnel/prep area was exposed to caustic chemicals and the employer had not assessed the physical hazards associated with the application of the chemical "One Step Low Foam" also known as Bug Goo. This resulted in an employee receiving chemical burns to their knees and legs requiring hospitalization.  b) This was most recently demonstrated on or about May 22, 2023, and at times prior to when employees were exposed to occupational noise above that OSHA action level of 85 decibels on a time-weighted average of 8 hours and the employer had not assessed the physical and health hazards associated with a noisy work environment.
