29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or before February 24, 2023, at the worksite located at 7332 Coleman Place, Lot 119, Pickerington, Ohio 43147, the employer failed to initiate and maintain a safety program such as but not limited to a scaffolding safety program and a fall protections program to ensure the identification and correction of common hazards employees were exposed to during residential construction activities.

29 CFR  1926.451(c)(2):Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation.  a. On or before February 24, 2023, at the worksite located at 7332 Coleman Place, Lot 119, Pickerington, Ohio 43147, the employer did not provide base plates or mud sills for the scaffolding legs. The employees used the scaffolding without adequate firm foundation and rested the scaffolding legs directly on the ground, thereby being exposed to fall hazards of up to 15 feet.

29 CFR  1926.451(g)(1)(vii):For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a. On or before February 24, 2023, at the worksite located at 7332 Coleman Place, Lot 119, Pickerington, Ohio 43147, the employer did not ensure that the employees were protected while working on scaffolding while working at heights of over 10 feet to the lower level. The employees were working on pump jack scaffolding at heights of 15 feet without any end rails, thereby being exposed to fall hazards of up to 15 feet.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. On or before February 24, 2023, at the worksite located at 7332 Coleman Place, Lot 119, Pickerington, Ohio 43147, the employer did not ensure that the employees were protected from falls while working at heights greater than 6 feet. The employees, without any means of fall protection, were working from the first story roof areas while installing siding, thereby being exposed to fall hazards of up to 10 feet, 6 inches.
