29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Waterbury Heating & Cooling, Inc at 8600 West Shoreline Place, Sioux Falls, SD 57107: On or about and at times prior to February 24, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. An employee was performing HVAC operations at the jobsite and suffered an injury after falling more than six feet through particle board and landing into a basement.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: (a) Waterbury Heating & Cooling, Inc at 8600 West Shoreline Place, Sioux Falls, SD 57107: On or about and at times prior to February 24, 2023, the exposing employer did not ensure employees were protected from falls in that a stairway floor opening leading to the basement did not have guardrails systems or covers. This condition exposed employees to fall hazards of greater than six feet.
