29 CFR  1910.23(c)(11):(11) The employer did not ensure that portable ladders used to gain access to an upper landing surface have side rails that extend at least 3 feet (0.9 m) above the upper landing surface.  On or about February 22, 2023, an employee used a 6 foot ladder to gain access to a 10 foot platform to retrieve parts. The side rails did not extend at least 3 feet above the upper landing surface, exposing the employee to fall hazards. When the employee was on their way to exit the platform they tripped and fell to the ground resulting in a broken arm. The employer did not ensure employees had a safe way to access the platform.  This item was corrected during inspection.

29 CFR  1910.28(b)(1)(i):(1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:   On or about February 22, 2023, an employee was retrieving parts from a 10-foot platform with no means of fall protection when they tripped and fell on their way down, resulting in a broken arm. The platform onto which the employee was gaining access had no protection to prevent employees from falling and the employer did not provide fall protection for their employees.  This item was corrected during inspection.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   On or about February 22, 2023, the employer failed to train and certify employees on how to safely operate a forklift. Employees with no forklift training operated the forklift to move pallets exposing other employees to struck-by hazards. Employees were also on the forks of the forklift with items such as refrigerators in order to stabilize them while being lifted to a 10 foot storage platform, exposing employees to crushing and fall hazards.  Abatement documentation is required for this item in accordance with the requirements in 29 CFR 1903.19(d).
