29 CFR 1910.134(g)(2)(i): When there was a change in the work area, conditions, or degree of employee exposure or stress that may effect respirator effectiveness, the employer did not reevaluate the continued effectiveness of the respirator: At the worksite located at 4722 Pear Street St., St. Joseph, MO: Employees were exposed to ingestion and inhalation hazards from lead. Employees are required to wear respiratory protection in the work area past the changeout area. Some employees are issued PAPRs (powered air purifying respirators). Batteries of these PAPRs (manufactured by 3M) are known by the company to stop functioning while in use by employees, specifically in the work area. Employees must lift PAPR hoods after the battery ceases functioning to be able to breathe due to lack of air; lifting the hood further leads to exposure to airborne lead.

29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces: At the worksite located at 4722 Pear Street St. Joseph MO: An employee was exposed to chemical hazards in the form of lead oxide. An employee was required to enter the baghouse of ball mill 10 to clear out lead oxide after the auger was choked up and could not be cleared using other methods.

29 CFR 1910.1025(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead: At a worksite located at 4722 Pear Street, St. Joseph, MO: Employees were exposed to hazardous chemicals in the form of lead. This was demonstrated on or about February 28, 2023, March 9, 2023, and May 24, 2023 and at times prior to when employees ate and drank in break areas where lead was present on various surfaces and PPE storage units such as lockers and boot bins. Failing to maintain surfaces that are as free as practicable from the accumulation of lead can create ingestion and inhalation hazards for employees. a) A wipe sample collected February 28, 2023, in the Obeya room on top of the printer showed levels of 203.9 micrograms of lead per 100 cubic centimeters. b) A wipe sample collected February 28, 2023, on a table in the cafeteria/breakroom showed levels of 20.8 micrograms of lead per 100 cubic centimeters. c) A wipe sample collected March 9, 2023, in the Pasting Huddle Room on the table by the AED showed levels of 352.0 micrograms of lead per 100 cubic centimeters. d) A wipe sample collected March 9, 2023, in the Pasting Supervisor's office next to the computer mouse showed levels of 212.0 micrograms of lead per 100 cubic centimeters. e) A wipe sample collected March 9, 2023, in cafeteria/breakroom on a table under the clock showed levels of 23.0 micrograms of lead per 100 cubic centimeters. f) A wipe sample collected March 9, 2023, in the cafeteria/breakroom on a table by window and ice cream machine showed levels of 21.3 micrograms of lead per 100 cubic centimeters. g) A wipe sample collected May 24, 2023, from the edges of locker 409 showed levels of 1351.9 micrograms of lead. h) A wipe sample collected May 24, 2023, from boot bin 305 showed levels of 4796.8 micrograms of lead. i) A wipe sample collected May 24, 2023, from the middle table between lockers 1-72/73-94 showed levels of 120.5 micrograms of lead per 100 cubic centimeters. j) A wipe sample collected May 24, 2023, from the ball mill drinking booth on top of the water dispenser showed levels of 78.9 micrograms of lead per 100 cubic centimeters. l) A wipe sample collected May 24, 2023, from the ball mill drinking booth on the inside of the door where a handle would be showed levels of 336.5 micrograms of lead per 100 cubic centimeters. m) A wipe sample collected May 24, 2023, from a microwave handle inside the cafeteria/breakroom showed levels of 20.1 micrograms of lead. n) A wipe sample collected May 24, 2023, from the handle of a food storage refrigerator in the cafeteria/breakroom showed levels of 64.4 micrograms of lead.
