OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from hazards associated with struck by hazards: a. Warehouse - On or about March 1, 2023, the rack systems throughout the warehouse was used to store materials on pallets were not placarded in accordance with MH16.1 section 1.4.2 and 1.4.3, to inform employees of the weight rating, exposing employees to a struck by hazard. b. Warehouse location T-17 - On or about March 1, 2023, Employees were working where the rack systems upright stanchion was damaged at the bottom of the leg, but had not been reevaluated to determine if it remained in a safe working condition c. Warehouse location U-01 - On or about March 1, 2023, Employees were working where the rack systems upright stanchion cross brace at approximately 1 foot off the ground and another at approximately 4 feet was damaged but had not been reevaluated to determine if it remained in a safe working condition. d. Warehouse location V-14 - On or about March 1, 2023, Employees were working where the rack systems upright stanchion was damaged at the bottom of the leg but had not been reevaluated to determine if it remained in a safe working condition. e. Warehouse location A2 - On or about March 1, 2023, Employees were working where the rack systems upright stanchion was damaged at the bottom of the leg but had not been reevaluated to determine if it remained in a safe working condition. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
