Note: The requirements applicable to construction work under this paragraph are identical to those set forth at ��1910.178(l) of this chapter. [44 FR 8577, Feb. 9, 1979; 44 FR 20940, Apr. 6, 1979, as amended at 58 FR 35183, June 30, 1993; 63 FR 66274, Dec. 1, 1998] 29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On or about March 1, 2023, SCI Roofing Services, LLC at a worksite located at 198 Penn St, Brilliant OH 43913: The employer did not ensure an employee who operated a Pettibone rough terrain powered industrial forklift, Model Number 8042, Serial number 7-531 to move/handle materials throughout the worksite were trained/certified to operate powered industrial equipment.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. a. On or about March 1, 2023, SCI Roofing Services, LLC at a worksite located at 198 Penn St, Brilliant OH 43913: The employer did not ensure each employee engaged steel erection activities at heights exceeding 20 feet were protected from falls. Employees were performing re-roof activities such as but not limited to the removal/replacement of insulation and metal decking at heights over 20 feet without any form of call protection. b. On or about March 1, 2023, SCI Roofing Services, LLC at a worksite located at 198 Penn St, Brilliant OH 43913: The controlling employer did not ensure each sub-contractor employees engaged in steel erection activities at heights exceeding 20 feet were protected from falls. Sub-contractor employees were performing re-roof activities such as but not limited to the removal/replacement of insulation and metal decking at heights over 20 feet without any form of fall protection.

The employer shall institute a training program and ensure employee participation in the program. a. On or about March 1, 2023, SCI Roofing Services, LLC at a worksite located at 198 Penn St, Brilliant OH 43913: employees were exposed to fall hazards while performing re-roof activities such as but not limited to the removal/replacement of insulation and metal decking on a commercial building. The employer did not ensure each employee was trained in the recognition/identification of fall hazards in the work area, the use/operation of fall protection/prevention systems, correct procedures for erecting, maintaining disassembling and inspected fall protection/prevention systems.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a. On or about March 1, 2023, SCI Roofing Services, LLC at a worksite located at 198 Penn St, Brilliant OH 43913: The employer did not ensure that a ladder used to access a commercial roof extended at least 3 feet beyond the upper landing and/or was secured with a grasping device. Employees performing re-roof activities were using a ladder for a means of access to the roof that extended approximately 12 inches above the eave, not secured and without a grasping device thereby exposing employees to fall hazards of 14 feet. b. On or about March 1, 2023, SCI Roofing Services, LLC at a worksite located at 198 Penn St, Brilliant OH 43913: The controlling employer did not ensure that a ladder used to access a commercial roof extended at least 3 feet beyond the upper landing and/or was secured with a grasping device. Sub-contractor employees performing re-roof activities were using a ladder for a means of access to the roof that extended approximately 12 inches above the eave, not secured and without a grasping device thereby exposing the employees to fall hazards of 14 feet.
