29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  Location: 68 Gardner Road, Nahant, MA;  On or about 03/01/23, workers were exposed to live electrical hazards and fall hazards of 20-feet above a lower level without adequate fall protection while performing siding work on a residential home due to the lack of employer oversight of the jobsite.

29 CFR  1904.40(a): The employer did not provide an authorized government representative the records within the four business hours.  Location: 68 Gardner Road, Nahant, MA;  On or about 03/01/23, the employer did not provide CSHO with copies of the injury and illness records as an authorized representative to the agency. CSHO gave employer 5 calendar days (3 business days) to provide the requested documentation and send it via email or official mail and the deadline was not met. Furthermore, employer representative(s) have pushed back to CSHO on the request and have attempted to deflect the responsibility on a subcontractor who does not employ more than 10 employees.
