29 CFR  1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  a) At the construction site, a written hazard communication program had not been developed and implemented.  Employees were exposed to hazardous substances such as silica when using Lehigh White Masonry Cement.

29 CFR  1926.451(g)(4)(i):  Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  a) At the jobsite on the front side of building 12, where there were no guardrails installed on the scaffold prior to use.  Employees were applying stones to the exterior of the building from a scaffold while the scaffold was being erected.

29 CFR  1926.451(g)(4)(xv):  Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail when the crossing point of two braces is not between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform.  The endpoints at each upright were more than 48 inches (1.3 m) apart:  a) At the jobsite on building 13, where employees were applying stone from the second tier of a scaffold without midrails.
