OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about February 25, 2023, at the job site located at 1095 South Rd. P Ulysses, Kansas, employees were exposed to struck-by hazards. Employees were required to dig a drainage ditch using a John Deere 325 G Skid Steer, SN: 1T0325GKCMJ399893, in conjunction with a John Deere BH8 Utility Backhoe attachment, SN: T0BBH08X130024 and were allowed to operate the equipment while in hazardous configurations. Among other feasible and acceptable means of abatement include but not limited to; Comply with the Association of Equipment Manufacturers (AEM) Skid Steer Loader Safety Manual, the National Institute of Occupational Safety and Health (NIOSH) Alert - Preventing Injuries and Deaths from Skid-Steer Loaders, and the John Deere Operators Manual for both the Skid Steer and the Backhoe attachment as follows: a) Ensure Operators are qualified to operate the Skid Steer and attachments through understanding of the written manufacturer's instructions, and actual operational training to comply with AEM Skid Steer Loader Safety Manual. b) Follow the manufacturer's instructions for attachment installation and safe operation to comply with the National Institute of Occupational Safety and Health (NIOSH) Alert - Preventing Injuries and Deaths from Skid-Steer Loaders. c) Comply with all safety instructions, warnings, cautions, and operational procedures set forth through the Operator's Manual as prescribed by the manufacturer. Additionally, ensure that all operators are provided with the operator instructions to comply with the SAE International Skid Steer loader safety standard J1388 [SAE 2008].
