29 CFR 1926.1053(b)(1): Employees were using a portable ladder to access an upper landing surface; the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. However, the ladder's length could extend to the required length. In addition, the ladder was not secured at its top to a rigid support that would not deflect, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder. (a) Jobsite, 2800 Hoffer Street, Harrisburg, PA - On or about March 1, 2023, employees were performing work on a residential second-story window approximately 12 feet 8 inch above grade at the lower lip of the window. Employees used a ladder not extended at least three feet above the upper landing surface. In addition, the ladder was not secured to a rigid support, and there was no grasping device in place. Employees were exposed to fall hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (a) Jobsite, 2800 Hoffer Street, Harrisburg, PA - On or about March 1, 2023, employees were performing work on a residential second-story window approximately 12ft 8in above grade at the lower lip of the window. Employees used a 24-foot ladder extended to an approximate working length of 13 feet. The foot of the ladder was located approximately 5 feet from the bottom edge of the wall that the top part of the ladder was braced on. As a result, employees were exposed to fall hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
