On or about March 2, 2023, and at times prior thereto, employees utilized an N95 respirator without having passed the appropriate fit test, exposing the employees to various respiratory related hazards.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. On or about March 2, 2023, and at times prior thereto, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring its use. The employer required all employees to wear N95 filtering facepiece respirators to protect against COVID-19 while working within the facility when confirmed positive COVID-19 residents were present, exposing employees to physiological hazards. Bell Nursing Operations, LLC was previously cited for a violation of this occupational safety and health standard (29 CFR 1910.134(e)(1)), which was contained in OSHA inspection number 1552259, citation number 1, item number 1 and was affirmed as a final order on 03-25-2022, with respect to a workplace located at 5000 Thayer Drive, Killeen, TX 76549.
