29 CFR  1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a) On March 2, 2023, located on the front portion of the commercial structure employees operating a Genie S-60X aerial lift while driving through muddy terrain were exposed to a fall hazard wearing their harnesses without the lanyard connecting them to the engineered tie-off points within the basket.

29 CFR  1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On March 2, 2023, the employer failed to designate a competent person to inspect there was equipment such as the fall protection systems and/or devices being maintained and utilized in a safe condition as employees were exposed to a fall hazard wearing a harness without the lanyard attached to the boom or basket.
