OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees are constantly walking/working in area where damaged rack system upright supports have battery stations stored on top of them, thus exposing them to a struck by hazard. Location: 2220 91st St., North Bergen, NJ 07047 On or about: March 3, 2023 a) Damaged rack system uprights supports and anchor points were not taken out of service, repaired, or replaced before battery stations were stored on them. Employees were exposed to struck by hazards on a daily basis when parking equipment and/or taking equipment at the charging stations.

29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: Location: 2220 91st St., North Bergen, NJ 07047 On or about: March 3, 2023 a) Employee who was operating equipment that included, but was not limited to a Raymond R101 forklift, was not looking in direction of travel, struck another employee while traveling in reverse.
