On or about March 2, 2023, and times prior thereto employees conducted roofing materials application operations at this single family residential structure under construction employees worked in areas where there was possible dangers of head injury from impact and were not protected by protective helmets.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. On or about March 2, 2023, and times prior thereto employees conducted roofing materials application operations at this single family residential structure under construction worked at the height of greater than 6 feet above a lower level, and did not have a fall protection system in place. Mr. Juan Anguiano has been cited two times prior for 1926.501.(b)(13) once in Inspection # 1626630 with a final order date of 04-07-2023 and a second occurrence Inspection # 1484924 with a final order date of 01-27-2021.
