29 CFR 1910.146(d)(3)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including specifying acceptable entry conditions:  a.  On or about March 2, 2023, the employer did not specify acceptable and safe entry conditions for employees assigned to enter permit spaces, such as the #4029 Mississippi Tank Company manufactured tanker trailer.  An employee who entered the trailer to conduct an inspection was exposed to atmospheric hazards, such as oxygen deficiency and flammable gasses.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

An employee who entered the trailer to conduct an inspection was exposed to atmospheric hazards, such as oxygen deficiency and flammable gasses.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

Employees entering the trailer without atmospheric testing and monitoring were exposed to atmospheric hazards, such as oxygen deficiency and flammable gasses. 29 CFR  1910.146(d)(9): The employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and for preventing unauthorized personnel from attempting a rescue:  The employer failed to develop and implement procedures for rescuing entrants from permit spaces and failed to develop procedures to prevent unauthorized personnel from attempting a confined space rescue.   On or about March 2, 2023, an employee collapsed in a confined space and a second employee entered the space and collapsed while attempting a rescue.  The employer had not developed or trained employees on how to rescue employees from confined spaces, such as the #4029 Mississippi Tank Company manufactured tanker trailer, exposing them to atmospheric hazards, such as oxygen deficiency and flammable gasses.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.146(g)(1):The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:  On or about March 2, 2023, the employer did not provide adequate permit space training to employees who were required to perform work in confined spaces, such as the #4029 Mississippi Tank Company manufactured tanker trailer.  Employees conducting inspections and repair work inside of tanker trailers were exposed to atmospheric hazards, such as oxygen deficiency and flammable gasses, in that they did not know what safe entry conditions were, did not know how to test atmospheric conditions, did not know how to fill out an entry permit, or how to rescue employees from inside of tanker trailers.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
