OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by hazards:  (a) On or about 3/3/2023: 5835 Route 5, Herkimer, NY 13350:  Employer failed to ensure that employees used equipment such as a 22-Ton NAPA 791-5280 Jack Stand to lift vehicles safely and according to the manufacturer's instructions, which exposed employees to crush-by-hazards by from vehicles falling off the jack stand.  (b) On or about 3/2/2023: 5835 Route 5, Herkimer, NY 13350:  Employer failed to ensure that employees used equipment such as a 22-Ton NAPA 791-5280 Jack Stand to lift vehicles safely and according to the manufacturer's instructions, which exposed employees to crush-by-hazards by from vehicles falling off the jack stand.  Abatement documentation is required for this item.

29 CFR  1910.244(a)(2)(iii): Loads were not cribbed, blocked, or otherwise secured immediately after they were raised with a jack.  a) On or about 3/3/2023, Vehicle Maintenance Bay, Marcy Excavation Services, LLC. located at 5835 NY-5, Herkimer, NY 13350: Employees were exposed to crush by hazards when using a single 22-ton NAPA  Jack Stand while servicing an attenuation truck and not chalking, blocking or securing the vehicle.  b) On or about 3/2/23, Vehicle Maintenance Bay, Marcy Excavation Services, LLC. located at 5835 NY-5, Herkimer, NY 13350: Employees were exposed to crush by hazards when using a single 22-ton NAPA  Jack Stand while servicing an attenuation truck and not chalking, blocking or securing the vehicle.
