29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) New Wooden Pole Building - Employees walked on and worked from wood roof truss members and wall top plates to install roof purlins on the truss top chords, at least 16 feet above grade, and the employees did not use guardrail systems, safety net systems, or personal fall arrest systems for protection from falling to a lower level, on or about March 8, 2023. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1926.602(c)(1)(vii): Unauthorized persons were allowed to ride on a powered industrial truck: (a) New Wooden Pole Building - Employees rode on the forks of the Ingersoll Rand VR-642C rough terrain forklift, along with a load of 2x4 wood purlins, to get to the top plate of the wooden pole building under construction, exposing the employees to hazards, including falling 16 feet to grade, on or about March 8, 2023. No abatement certification or documentation required.
