29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) Corner of Liberty Street and West Genesee Street, Syracuse, NY 13204: On or about March 8, 2023, employees were tying in the water main in a trench measuring 6 feet 8 inches without use of a trench box. The employer failed to ensure an inspection by the competent person of an excavation and its protective systems for evidence of a situation that could have resulted in possible cave-ins and other hazardous conditions were made by a competent person.
