29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about March 7th, 2023, employees of Scott Thane Ditching Service, Inc. engaged in trenching operations were exposed to caught-in hazards from the soil not being two feet back from the edge of the trench. Scott Thane Ditching Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 1528035, citation number one, item number three, and was affirmed as a final order on July 7, 2021, with respect to a workplace located at Mardi Gras 5th and Riverboat Blvd, Odessa, TX.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about March 7th, 2023, employees of Scott Thane Ditching Service, Inc. engaged in trenching operations were exposed to engulfment hazards while working in a trench in excess of 5 feet without any cave-in protection. Scott Thane Ditching Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1528035, citation number one, item number four, group a, and was affirmed as a final order on July 7, 2021, with respect to a workplace located at Mardi Gras 5th and Riverboat Blvd, Odessa, TX.
