29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) 29 Lafayette Street, Spring Valley, NY (New Residential Construction): An employee engaged in roofing work, was using a handheld pneumatic nail gun, and was not wearing eye and face protection. The employer did not ensure that employees were wearing eye and face protection, while exposed to a struck by hazard, on or about 3/6/23.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 29 Lafayette Street, Spring Valley, NY (New Residential Construction): Employees were required to install roofing material on a residential home, and were exposed to a fall hazard of over 30 feet above the lower surface, without the use of a personal fall arrest system. The employer did not ensure that employees were provided with a personal fall arrest system, or other means of fall protection, thus exposing employees to a fall hazard, on or about 3/6/23.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) 29 Lafayette Street, Spring Valley, NY (New Residential Construction): Employees engaged in roofing work were required to access the roof from an extension ladder, and the ladder did not extend at least 3 feet above the roof's landing. The employer did not ensure that an extension ladder used to access the roof, was extended to at least 3 feet above the upper landing surface, on or about 3/6/23.
