29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a. On or about March 1, 2023, Nelson Sanchez at a worksite located at 198 Penn St, Brilliant OH 43913: The employer did not initiate, maintain and enforce safety and health programs such as but not limited to a ladder safety program and fall protection/prevention programs for employees performing a re-roof on a commercial building. The following condition exposed employees to the falls between 14 and 20 feet.

29 CFR  1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.   a. On or about March 1, 2023. Nelson Sanchez at a worksite located at 198 Penn St, Brilliant OH 43913: Employees were performing re-roof activities such as but not limited to the removal/replacement of insulation and metal decking. The employer did not ensure  each employee engaged these activities were protected from falls.  As a result, the employees were exposed to fall hazards of over 22 feet.

29 CFR  1926.761(b): Fall hazard training. The employer shall train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program.   a. On or about March 1, 2023, Nelson Sanchez at a worksite located at 198 Penn St, Brilliant OH 43913: Employees were exposed to fall hazards  while performing re-roof activities such as but not limited to the removal/replacement of insulation and metal decking on a commercial building. The employer did not ensure each employee was trained in the recognition/identification of fall hazards in the work area, the use/operation of fall protection/prevention systems, correct procedures for erecting, maintaining disassembling an inspected fall protection/prevention systems.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   a. On or about March 1, 2023, Nelson Sanchez  at a worksite located at 198 Penn St, Brilliant OH 43913: The employer did not ensure that a ladder used to access a commercial roof extended at least 3 feet beyond the upper landing and/or was secured with a grasping device. Employees performing re-roof activities were using a ladder for a means of access to the roof that extended approximately 12 inches above the eave, not secured and without a grasping device thereby exposing employees to fall hazards of 14 feet.
