OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees   Material Hoists  A) 317 Simpson Place, Peekskill - NY: Employees were exposed to fall hazards of approximately 26 feet while engaged in roofing work on a residential structure. The employees were using the material hoist as a ladder on or about December 5th, 2022.  HAZARD RECOGNITION: The RGC Material Hoist has placards that including the following warning " DO NOT CLIMB, MATERIALS HOIST ONLY", "WARNING NO RIDERS", "200 lbs caps, DO NOT EXCEED". On page 2 of the RGC material hoist P225 Platform Hoist Instruction Manual states "WARNING: NEVER CLIMB ON THE TRACK. THIS CAN CAUSE SERIOUS PERSONAL INJURY OR DEATH. USE THE LADDER. Mr. Russo stated that he was using the RGC material hoist to access the roof.      POTENTIAL FOR DEATH OR SERIOUS HARM: The manufacturer Reimann & George Corporation P225 Platform Hoist Instruction Manual states NEVER climb the track; use a ladder (page 2).  On page 7 of the manual states: "WARNING: NEVER CLIMB ON THE TRACK. THIS CAN CAUSE SERIOUS PERSONAL INJURY OR DEATH. USE THE LADDER.       FEASIBLE ABATEMENT METHOD: The employee must use a ladder or other method of accessing the roof, or elevated landing when an RGC Material Hoist is used.         SEARCH VERIFICATION: A search of the Construction Industry Standard did not reveal an appropriate Occupational Health and Safety Standard that can be used for RGC Material Hoist as a ladder. The improper use of the RGC material hoist can be hazardous and could result in serious injury or death (page 2, 7).
