29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  On or about May 26, 2023, the employer failed to submit documentation and certification of corrective action for citation 1 item 1 issued on March 20, 2023 with an abatement due date of March 30, 2023.  On or about May 26, 2023, the employer failed to submit documentation and certification of corrective action for citation 1 item 2 issued on March 20, 2023 with an abatement due date of March 30, 2023.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  On or about March 10, 2023, employees engaged in residential construction activities were exposed to fall hazards in excess of 6-feet without using any form of fall protection.  JCM Roofing was previously cited for a violation of this occupational safety and health standard (29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1631936, citation number 1, item number 1 and was affirmed as a final order on (February 28, 2023), with respect to a workplace located at 805 Durham Horizon City, TX 79928.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  On or about March 10, 2023, employees engaged in residential construction were exposed to falls greater than 6-feet due to inadequacies in fall protection training.  JCM Roofing was previously cited for a violation of this occupational safety and health standard (29 CFR 1926.503(c)(3), which was contained in OSHA inspection number 1631936, citation number 1, item number 2 and was affirmed as a final order on (February 28, 2023), with respect to a workplace located at 805 Durham Horizon City, TX 79928.
