Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii):   a) Milling Room - Employees were exposed to a fall hazard of approximately ten (10) feet high when working on the unprotected ladder opening of the milling and sifter platform, on or about March 10, 2023.    Abatement certification required.

29 CFR 1910.29(b)(10): The employer did not ensure that when guardrail systems are used at hoist areas, a removable guardrail section, consisting of a top rail and mid rail, is placed across the access opening between guardrail sections when employees are not performing hoisting operations. The employer may use chains or gates instead of a removable guardrail section at hoist areas if the employer demonstrates the chains or gates provide a level of safety equivalent to guardrails:  a) Milling Room- Employees working near hoist areas were exposed to fall hazards of up to ten (10) feet because swing gates were not used, on or about March 10, 2023.
