29 CFR 1926.651(k)(1): Daily inspections of excavations and adjacent areas, were not made by a competent person for evidence of a situation that could result in possible cave-ins, or other hazardous conditions. An inspection was not conducted as needed throughout the shift to provide adequate barriers to prevent employees from stepping into an open excavation or tripping along the open edge. a) On or about 03/09/2023, at the BJ's Restaurant, under construction, located on 760 Jefferson Road, in Rochester, New York, Employer did not enforce the use of protective barriers around an unattended open excavation measuring 4 feet 89 inches deep to prevent employees from falling, or stepping into the excavation. Employees were allowed to walk along open sides of the excavation and were exposed to falls. NO ABATEMENT CERITFICATION REQUIRED
