29 CFR 1910.120(q)(9)(i): Members of an organized and designated HAZMAT team and hazardous materials specialist did not receive a baseline physical examination and/or was not provided with medical surveillance as required in 29 CFR 1910.120(f):   a) Kunzler & Company, Inc. - 652 Manor Street, Lancaster, PA 17604 - On or about March 12, 2023, the employer did not institute a medical surveillance program for members of the HAZMAT team.  An ammonia leak occurring at the facility which required the employer to activate their HAZMAT team required employees to conduct emergency response operations without baseline physical examinations or medical surveillance.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.134(m)(2)(i): The employer did not establish a record of the qualitative and quantitative fit tests administered to an employee which included the information required by 29 CFR 1910.134(m)(2)(i)(A) through (m)(2)(i)(E):  a) Kunzler & Company, Inc. - 652 Manor Street, Lancaster, PA 17604 - On or about March 13, 2023, the employer did not generate a record of the employee's fit test at the time the fit test was conducted for employees who were required to wear respiratory protection as part of the HAZMAT team.  No abatement documentation or certification is required.
