The employer failed to provide employees with the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

29 CFR 1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: On or about 03/09/2023 at 7 East 7th Street New York, NY 10003 employees in the Sculpture Shop have exposure to crystalline silica contained in the product Satin Cast #20. This exposure occurs while employees are assisting students with investment and de-investment procedures. The employer failed to assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3). 29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv): In the alternative 29 CFR 1910.1053(j)(3)(i): The employer did ensure that each employee covered by this section could demonstrate knowledge and understanding of the health hazards associated with exposure to respirable crystalline silica; specific tasks in the workplace that could result in exposure to respirable crystalline silica; specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica; the contents of this section; and the purpose and a description of the medical surveillance program required by paragraph (i) of this section: On or about 03/09/2023 at 7 East 7th Street New York, NY 10003 employees in the Sculpture Shop use and assist students in the use of hazardous chemicals including but not limited to acetylene gas used in welding and respirable crystalline silica contained in the Satin Cast 20 product used during casting. The employer failed to train employees on (h)(3)(i) through (h)(3)(iv) as required by the standard.
