29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  a) Nicholson Corporation building 5519 Nashville Street McGuire AFBV, NJ 08641:  On or about 2/27/2023, employee(s) tasked with scrapping paint from walls were exposed to lead. The employer did not provide employees with training on how to recognize the presence of lead based paint and the actions to take to avoid exposure.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.62(d)(1)(i):Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30 �?g/m3) calculated as an 8-hour time-weighted average (TWA):  a) Nicholson Corporation building 5519 Nashville Street McGuire AFBV, NJ 08641:  On or about 2/27/2023, The employer did not conduct an initial assessment to determine if employees scrapping paint from walls were exposed to lead above the action level.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION AND DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
