The employer was failing to protect employee(s) from struck-by/impact injuries. This was most recently documented on or about March 14, 2023, at the corner of South 216th Street and Parkview Drive, Gretna, Nebraska. The employer failed to ensure that employee(s) were not exposed to the hazards associated with loose soil and excavating equipment above them.

1926.652(b) The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): 29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system. The employer was failing to protect employee(s) from cave in hazards. This was most recently observed on or about March 14, 2023, at the corner of South 216th Street and Parkview Drive, Gretna, Nebraska. The employer failed to ensure that employee(s) were protected from cave-in hazards in that no protective system was in place while employee(s) worked in an excavation that was 8 feet in depth with vertical walls.
