OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible dust deflagration, explosion, and other fire hazards from the deficient design and/or implementation of preventative and/or protective measures in the Power House fly ash conveying system and Cyclone Room paper dust collection system:  a) Wood Shop  - On or about 3/09/2023, and at times prior, the employer exposed employees to fire hazards associated with combustible dusts in the event of a deflagration or other uncontrolled fire event in that, although the table saw was equipped with a dust collector it was not working properly, and did not remove accumulated combustible dust that was generated by other wood cutting equipment such as, but not limited to, the DeWalt chop saw.

29 CFR  1910.22(a)(1): Poor housekeeping in the work area created unsafe conditions.  a) Wood shop area - On or about 3/09/2023, and at times prior, the employer exposed employees to fire hazards created by combustible wood dust (e.g.: fire hazards to including flames and hazardous byproducts: smoke, toxic gases, etc.) and slip hazards in that, the flooring of the Wood Shop area was not maintained in a clean and safe condition. Excessive wood dust was allowed to accumulate on the walking/working surfaces and around the DEWALT chop saw.
