29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  On or about June 6, 2023, the employer failed to submit abatement documentation and Certification of Corrective Action for citation 1 item 2, issued on April 20, 2023, with an abatement due date of May 9, 2023. 29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems:  On or about March 13, 2023, employees were engaged in roofing activities 6 feet or more above the lower level without the use of fall protection. This condition exposed employees to a fall hazard.  MTM Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1453807, citation number 1, item number 1 and was affirmed as a final order on 03-18-2020, with respect to a workplace located at 400 Vin Etienne Dr., El Paso, TX 79912.  MTM Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1480507, citation number 1, item number 1 and was affirmed as a final order on 08-04-2020, with respect to a workplace located at 440 Vin Marbella Dr., El Paso, TX 79912.

29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.   On or about March 13, 2023, employees engaged in roofing operations were exposed to fall hazards in excess of 6-feet due to inadequacies in fall protection training program.    MTM Roofing, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1491976, citation number 1, item number 2 and was affirmed as a final order on February 16, 2022, with respect to a workplace located at 170 Vin Marbella Dr., El Paso, TX79912.  MTM Roofing, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1480507, citation number 01, item number 002 and was affirmed as a final order on August 4, 2020, with respect to a workplace located at 440 Vin Marbella Dr., El Paso, TX79912.
