29 CFR 1926.1207(b)(5): Training was not provided by the employer when there was evidence of inadequacy in employee's knowledge of confined space procedures: (a) East Side of Killinger Road (behind Rutter's Store #68), Annville, Pennsylvania - An employee worked in a trench 19 feet deep to install new storm sewer piping and structures. The employee did not have a safe means of egress in that to exit the 24-foot long, 19-foot deep trench, the employee entered the newly installed 5-foot diameter storm sewer piping, walked about 270 feet underground through this buried piping to the bottom of the newly installed storm sewer manhole 65, and climbed manhole 65's internal fixed ladder rungs to get to grade level, exposing the employee to permit-required confined space hazards, including potential atmospheric hazards such as oxygen deficiency, on or about March 15, 2023. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1203(a): Before it began work at a worksite, each employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may work and identified each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary: (a) East Side of Killinger Road (behind Rutter's Store #68), Annville, Pennsylvania - The foreman, designated as the competent person, allowed an employee to access the 19-foot deep trench, in the area where manhole 64 would get installed, by entering manhole 65 and walking underground about 270 feet through 5-foot diameter buried storm sewer piping, which terminated within a trench box in the open trench in the area of manhole 64's designated location. The foreman determined that manhole 65 and the 270 feet of 5-foot diameter buried storm sewer piping classified as a confined space but not a permit-required confined space with potential atmospheric hazards based on the fact that the manhole and piping were new rather than on atmospheric testing, on or about March 15, 2023. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1203(d): When the employer decided that employees it directed would enter a permit space, that employer did not implement at the construction site a written permit space entry program that complied with 29 CFR 1926.1204: (a) East Side of Killinger Road (behind Rutter's Store #68), Annville, Pennsylvania - The employer decided to have an employee enter a portion of the newly installed storm sewer system. The employee entered manhole 65, then entered the 5-foot diameter storm sewer piping connected at the bottom of manhole 65, and walked southward underground about 270 feet through the 5-foot diameter buried storm sewer piping, to access a 19-foot deep trench, on or about March 15, 2023. For this permit space entry into the manhole and piping, the employer did not implement a written permit space entry program, which complied with 1926.1204, including, but not limited to, not using an entry permit, not conducting atmospheric testing prior to or during entry, and not including provisions for rescue and emergency services, exposing the employee to permit space hazards, including potential atmospheric hazards such as oxygen deficiency. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
