29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) For the elevator shaft work at construction site Sentosa Lexington Oaks Apartments 5085 Post Oak Blvd, Wesley Chapel, FL, on or about 03/15/2023, the employer exposed employees to potential respiratory hazards, in that, employees were not provided with a medical evaluation to determine their ability to use a respirator (N-95/P-95 respirators) before being required to wear them. Employees were wearing N-95/P-95 respirators while cutting concrete with masonry saws and grinders.

29 CFR 1926.300(a):Hand tool(s), power tool(s) or similar equipment were not maintained in a safe condition: a) For the elevator shaft work at construction site Sentosa Lexington Oaks Apartments 5085 Post Oak Blvd, Wesley Chapel, FL, on or about 03/15/2023, the employer exposed employees to laceration and amputation hazards, in that, a 4.5 inch Dewalt angle grinder (12,000 rpm max) was used to cut concrete with a 7 inch Ridgid diamond masonry blade (8,730 rpm max). This condition resulted in the potential for the blade to become unstable and contact employees due to its large size and lesser rpm rating.
