29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)G&G Construction Company, Inc. at 100 Quality Park Drive, Beresford, SD 57004: On or about and at times prior to March 15, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting roofing operations on a commercial property without the use of a fall protection system, lack of fall protection while utilizing aerial lifts, forklift hazards, and lack of training. This condition exposed employees to fall hazards of greater than six feet.

29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  (a)G & G Construction Company, Inc. at 100 Quality Park Drive, Beresford, SD 57004:  On or about and at times prior to March 15, 2023, the exposing employer did not ensure that employees operating the GEHL Model RS6-42, All-Terrain Forklift had successfully completed the required training prior to operating the forklift.  This condition exposed employees to struck-by hazards associated with improper use o f the all-terrain forklift.

The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  (a)G & G Construction Company, Inc. at 100 Quality Park Drive, Beresford, SD 57004:  On or about and at times prior to March 15, 2023, the exposing employer did not ensure that employees were protected from falls while working from the JLG Model 400S Aerial Lift while conducting commercial construction activities.
