29 CFR  1910.95(k)(1):The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program:  Lake Erie Frozen Foods Manufacturing, Co. doing business as Lake Erie Frozen Foods, Co.  located at 1830 Orange Road in Ashland, Ohio 44805:  Instance A  On or about April 20, 2023, the employer did not ensure a training program was instituted for employees who were exposed to noise at or above an 8-hour time weighted average of 85 decibels. On May 31, 2023, an employee, inspector (breading), was exposed to noise at 144% of the permissible daily dose, or an average sound level of 94.5 decibels, as measured over 370 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 92.6 decibels accounting for the period of 110 minutes unmonitored. Employees were exposed to hazards associated with high noise levels such as, but not limited to, hearing loss.      Instance B   On or about April 20, 2023, the employer did not ensure a training program was instituted for employees who were exposed to noise at or above an 8-hour time weighted average of 85 decibels. On May 31, 2023 an employee, feeder, was exposed to noise at 85% of the permissible daily dose, or an average sound level of 88.9 decibels, as measured over 474 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 88.8 decibels accounting for the period of 6 minutes unmonitored. Employees were exposed to hazards associated with high noise levels such as, but not limited to, hearing loss.      Instance C  On or about April 20, 2023, the employer did not ensure a training program was instituted for employees who were exposed to noise at or above an 8-hour time weighted average of 85 decibels. On May 31, 2023, an employee, inspector (battered), was exposed to noise at 87% of the permissible daily dose, or an average sound level of 89.6 decibels, as measured over 444 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 89.0 decibels accounting for the period of 36 minutes unmonitored. Employees were exposed to hazards associated with high noise levels such as, but not limited to, hearing loss.      Instance D  On or about April 20, 2023, the employer did not ensure a training program was instituted for employees who were exposed to noise at or above an 8-hour time weighted average of 85 decibels. On May 31, 2023, an employee, packing machine operator, was exposed to noise at 136% of the permissible daily dose, or an average sound level of 92.3 decibels, as measured over 469 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 92.2 decibels accounting for the period of 11 minutes unmonitored. Employees were exposed to hazards associated with high noise levels such as, but not limited to, hearing loss.

29 CFR  1910.212(a)(3)(ii):Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):  Lake Erie Frozen Foods Manufacturing, Co. doing business as Lake Erie Frozen Foods, Co.  located at 1830 Orange Road in Ashland, Ohio 44805:  On or about April 20, 2023 the employer did not ensure employees were protected from point of operation hazards on the APV Crepaco Inc. Mixer (serial number 00248**3-0202). Employees were exposed to caught-in and amputation hazards when dumping ingredients into the mixer during operations.

29 CFR  1904.41(a)(1):29 CFR 1904.41(a)(1) If your establishment had 250 or more employees at any time during the previous calendar year, and this part requires your establishment to keep records, then you must electronically submit information from the three recordkeeping forms that you keep under this part (OSHA Form 300A Summary of Work-Related Injuries and Illnesses, OSHA Form 300 Log of Work-Related Injuries and Illnesses, and OSHA Form 301 Injury and Illness Incident Report) to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the forms.  Lake Erie Frozen Foods Manufacturing, Co. doing business as Lake Erie Frozen Foods, Co. located at 1830 Orange Road in Ashland, Ohio 44805:  On or about March 2, 2023 the employer failed to electronically submit the company's OSHA Form 300A Summary of work related injuries and illnesses for 2022 calendar year to OSHA's Injury Tracking Application (ITA). The employer, specializing in the manufacturing of coated food products, NAICS 311412, had an average of 90 employees at the Ashland, Ohio facility in 2022 requiring them to submit the OSHA 300 A information to OSHA by March 2, 2023.
