OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, that employees were exposed to crushing hazards, struck-by hazards, and ejection hazards during the operation of powered industrial trucks: a) On or about March 16, 2023, and at times prior, employees of Tates Rents, Inc. were exposed to crushed-by hazards, in that the Yale forklift Model: GLP050ZGEGAE090/Serial#: A875B27340B was operated without a functional seat belt assembly.
