29 CFR  1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation  a) Trench: On or about March 13, 2023, and at times prior, the employer exposed employees to cave-in/entrapment hazards, in that the employer did not provide a water removal system to control water accumulation while employees worked in a trench which measured 65 feet long by 14 feet wide by 17-18 feet  deep for the purpose of installing new water line.

29 CFR  1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary  a)  On or about March 13, 2023, and times prior, the employer exposed employees to cave-in/entrapment hazards, in that  the spoil pile was not kept at least 2 feet from the edge of the excavation while employees worked in a trench which measured 65 feet long by 14 feet wide by 17-18 feet deep for the purpose of installing new water line.   b)  On or about March 13, 2023, and times prior, the employer exposed employees to cave-in/entrapment hazards, in that excavation equipment was not kept at least 2 feet from the edge of the excavation while employees worked in a trench which measured 65 feet long by 14 feet wide by 17-18 feet deep for the purpose of installing new water line.

29 CFR  1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions  a)  On or about March 13, 2023, and times prior, the employer exposed employees to cave-in/entrapment hazards in that the employer failed to ensure that a competent person conducted daily inspections of the excavation prior to the beginning of the day and as needed to determine if hazards are present where employees worked in a trench which measured 65 feet long by 14 feet wide by 17-18 feet deep for the purpose of installing new water line.
