Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about March 07, 2023, the employer did not ensure a competent person conducted regular inspections of the job site, materials, and equipment. As a result, a chainsaw was improperly used, leading to employee injuries. Further, the employer failed to recognize that appropriate personal protective equipment for the workers engaged in the tasks were not provided.

The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about March 07th, 2023, the employer failed to instruct employees in recognizing and avoiding unsafe conditions, specifically when using hand-power tools like the Stihl chainsaw MS 201 TC and working at heights. As a result of this failure, an employee was injured due to a chainsaw kick-back while cutting utility poles.

29 CFR 1926.95(a): Personal Protective and Life Saving Equipment. Criteria for personal protective equipment. "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) On or about March 07, 2023, the employer failed to ensure that employees engaged in the removal of idle utility poles from a height of at least 15 ft. used personal protective equipment such as but not limited to, chainsaw-resistant clothing, while operating a Stihl chainsaw MS 201 TC. As a result, an employee was injured due to a chainsaw kick-back while cutting utility poles.
