29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about 03/16/2023, at the Tesla Service Center, under construction located at 3535 West Henriette Road, in Rochester, New York, the employer did not enforce the use of protective systems to provide cave-in protection from falling excavated soil and rock. Employees were allowed to enter an excavated trench 6 feet 4 inches deep to "tie in" a water main, exposing employees to serious hazards from falling excavated soil material. NO ABATEMENT CERTIFICATION REQUIRED
