OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by, impalement, and crushing hazards during livestock movement in alleys and into holding pens. On or about March 15, 2023, and at times prior, employees working in the livestock alleys and penning area were exposed to struck-by, impalement and crushing hazards when trying to move livestock (particularly bulls) through the alleys into holding pens. While moving livestock, employees open and close a series of swing gates while in close proximity to the livestock resulting in potential struck -by, impalement, and crushing hazards directly from livestock and livestock forcefully contacting gates.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. On March 15, 2023 at approximately 10:47AM an employee sustained injuries resulting in in-patient hospitalization after being struck by a metal gate and/or a bulls hoof while manually operating a metal gate of a pen containing 6 bulls. The employer did not report the hospitalization within 24-hours.
