On or about March 21, 2023, located at the jobsite 275 W Wisconsin Ave. Milwaukee, WI 53203, the employer did not perform frequent and regular job site inspections to identify and correct safety hazards.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a. On or about March 21, 2023 at the jobsite located at 275 W Wisconsin Ave, Milwaukee, Wisconsin 53203, an employee was performing work on an elevated work area located above a vendor location without the use of fall protection, therefore exposing employee to a fall hazard of approximately nine feet five inches.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.  a. On or about March 21, 2023 at the jobsite located at 275 W Wisconsin Ave, Milwaukee, WI 53203, employee was observed using a 10 foot self-supporting (A-frame) ladder in the closed position to access the upper landing above the Kawa Sushi and Ramen vendor station, the ladder did not extend above the upper landing and was not secured to the landing exposing employee to a fall hazard.
