29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. a. On or about March 21, 2023, at the jobsite located at 1265 Woodview Dr. Waukesha, WI 53189 employees were installing siding on residential home from a pump jack scaffold without the use of fall protection, exposing employees to an approximately twelve (12) feet fall from the area or operation.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about March 21, 2023, at the jobsite located at 1265 Woodview Dr. Waukesha, WI 53189 , employees were conducting siding work from the roof of an existing residential house without being protected from falling to the lower level. This exposed employees to a fall hazard of approximately eleven (11) feet from the roof.
