29 CFR  1910.147(c)(4)(i):  Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.   Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.  On or about March 20, 2023, at an establishment located at 6163 Kvitek Road in Denmark, Wisconsin, at the Front End Area;  the employer did not develop and document die setting procedures for the Dener Puma xl hydraulic press brake which provided exclusive control of the hazardous motion exposing employees to crushing hazards.

29 CFR  1910.178(a)(4):  Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  During the week of March 13, 2023, at an establishment located at 6163 Kvitek Road in Denmark, Wisconsin, at the Front End Area; a Nissan KCUGH02F30PV propane forklift had a hole in the fork which was used to move trailers around the facility without the manufacturers prior approval. The modification to the fork would affect the capacity and safe operation exposing employees to struck by hazards.

29 CFR  1910.178(l)(2)(ii):  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about March 21, 2023, at an establishment located at 6163 Kvitek Road in Denmark, Wisconsin, the employer did not ensure employees who operated the sit down propane forklifts completed a formal training program. Unevaluated and trained employees were using the forklift to move product and trailers around the facility and in the yard exposing employees to struck-by and crushing hazards.

At an establishment located at 6163 Kvitek Road in Denmark, Wisconsin, the employer did not evaluate each powered industrial truck operator's performance to ensure they had the knowledge and skill to operate safely. Unevaluated employees were using the forklift to move product and trailers around the facility and in the yard exposing employees to struck-by and crushing hazards.

29 CFR  1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  (a)  On or about March 17, 2023, at an establishment located at 6163 Kvitek Road in Denmark, Wisconsin, at the Front End Area; a Cincinnati Auto Shear 1812 was used to shear metal pieces to size or clean up pieces which were cuts on the various tables.  The backside of the shear was not guarded exposing employees to struck by hazards.  (b)  On or about March 17, 2023, at an establishment located at 6163 Kvitek Road in Denmark, Wisconsin, at the Front End Area; a Cincinnati Auto Shear 1812 was used to shear metal pieces to size or clean up pieces which were cuts on the various tables.  The hold down guard opening was adjusted to greater than one-quarter inch exposing employees to caught between and struck by hazards.  (c)  On or about March 20, 2023, at an establishment located at 6163 Kvitek Road in Denmark, Wisconsin, at the Back Shop Area; an Ellis horizontal bandsaw was used to cut tubing which had the unused portion of the blade exposed.  This exposed employees to struck by and caught between hazards.

The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  On or about March 17, 2023, at an establishment located at 6163 Kvitek Road in Denmark, Wisconsin, at the Front End Area; a Cincinnati Auto Shear 1812 was used to shear metal pieces to size or clean up pieces which were cuts on the various tables. The guard was adjusted to an opening greater than one-quarter inch allowing employees access to the point of operation and danger zone of the operating cycle.
